This Creator Agreement ("Agreement") governs participation as a seller ("Creator") on Merkosi ("Marketplace")

By applying and participating on Merkosi, Creator agrees to the following:

1. Original Work

Creator represents that all products listed on Merkosi are original work. Dropshipping and misrepresentation of production methods are prohibited. AI-generated listings or imagery used to misrepresent products are prohibited.

2. Catalog Policy

To preserve marketplace quality:

• Creators begin with a maximum of 15 live products.
• Expansion beyond 15 products requires Merkosi approval.
• Variations (size, color, material) must be structured within a single listing where possible.
• Duplicate or near-duplicate listings created for search exposure may be removed.

Merkosi reserves the right to reduce or freeze catalog expansion if necessary to protect marketplace integrity.

3. Listing Accuracy

Creator agrees to provide accurate and complete information, including materials, sizing, production times, and included components.

Listings that materially misrepresent products may be removed.

4. Production & Shipping

• Creator agrees to ship within the stated production time.
• Valid tracking must be uploaded promptly.
• Orders over $150 require signature confirmation when available.

5. Returns & Refunds

• 14-day return window unless otherwise stated on the listing.
• Custom/made-to-order items are final sale unless defective or not as described.
• Defect or damage claims may require photo evidence within 72 hours of delivery.
• Refunds are issued after returned items are received and inspected.

In the event of a confirmed chargeback or refund resulting from creator error, the creator is responsible for returning their 91% share of the order. Merkosi absorbs its commission and does not pass processing fees to the creator. Return shipping on confirmed defective items is covered by Merkosi.

Creator is responsible for refunds or chargebacks resulting from confirmed defects, misrepresentation, or fulfillment error.

6. Communication

Creator agrees to respond to buyer or Merkosi inquiries within 72 hours.

7. Payout Structure

• New creators are subject to a 14-day payout hold after delivery.
• Eligibility for reduced payout hold may be granted after demonstrated reliability.
• Merkosi may extend payout holds during disputes or investigations.

8. Sole Cultura Impartiality

Merkosi is founded by the owner of Sole Cultura, an active creator on the platform. Sole Cultura is subject to the same standards, commission structure, and enforcement policies as all other creators. It receives no preferential placement, pricing, or treatment.

9. Discounts and Promotions

Creators are never required or pressured to discount their work. Any platform-wide promotions or discounts offered by Merkosi are funded by Merkosi, not passed to creators.

10. Enforcement

Merkosi may:

• Request listing revisions
• Remove listings
• Reduce catalog limits
• Extend payout holds
• Pause or remove creator accounts for repeated or serious violations

11. Updates

Merkosi may update this Agreement as the marketplace evolves. Continued participation constitutes acceptance of updates.
