Welcome to Merkosi. These Terms of Service (“Terms”) govern your use of the Merkosi website and services. By accessing or purchasing from Merkosi, you agree to be bound by these Terms.

1. About Merkosi

Merkosi is a curated online marketplace operated by Merkosi LLC, designed to support independent creators and provide customers with thoughtfully made products. Merkosi is not an open marketplace. All creators are screened prior to being listed.

2. Eligibility

By using this site, you represent that you are at least the age of 18 and are legally capable of entering into binding agreements.

3. Marketplace Standards

To protect both creators and customers, Merkosi enforces strict platform standards.

The following are not permitted on Merkosi:

  • Mass-produced or factory catalog items not designed, owned, or meaningfully controlled by the creator

  • Dropshipping or print-on-demand catalogs without original creative input

  • Unauthorized use of copyrighted or trademarked material

  • Misrepresentation of authorship, origin, or production methods

Merkosi welcomes independent creators who manufacture their own products or work with production partners, provided the creator retains authorship, creative control, and responsibility for the work. Merkosi reserves the right to remove any product, creator, or content that violates these standards at its sole discretion.

4. Orders & Payments

All prices are listed in U.S. dollars unless otherwise stated. Payments are processed securely through Shopify Payments.

Merkosi reserves the right to refuse or cancel any order if fraud, abuse, or policy violations are suspected.

5. Returns & Refunds

Refunds and returns are governed by our Refund Policy, which is incorporated into these Terms. Due to the creator-driven nature of the marketplace, many items are final sale unless otherwise stated.

6. Intellectual Property

All content on this site, including text, images, branding, and design, is owned by Merkosi LLC or its creators and may not be used without permission.

Creators retain ownership of their original works. Customers may not reproduce or resell products without authorization.

7. Platform Integrity & Enforcement

Merkosi reserves the right to:

  • Suspend or terminate accounts

  • Remove listings or content

  • Refuse service

At any time, with or without notice, if we determine that platform standards or these Terms have been violated.

8. Creator Eligibility & Content Standards

Eligibility to Sell
To create a creator account or list products on Merkosi, you must be at least eighteen (18) years old. By registering as a creator or offering products for sale, you represent and warrant that you meet this age requirement. Merkosi reserves the right to suspend or terminate accounts found to be operated by individuals under the age of eighteen.

Original Content / No AI Policy
Merkosi is a original-work marketplace. creators may not list, sell, or distribute products, designs, artworks, or content that are wholly or substantially generated using artificial intelligence, machine learning models, or other automated content generation tools. Merkosi reserves the right to remove listings, deny creator access, or suspend accounts that violate this policy at its sole discretion.

Safe-for-Work Content Requirement
All products, listings, images, descriptions, and associated content on Merkosi must be safe for work (“SFW”). Explicit sexual content, pornographic material, fetish content, graphic violence, hate speech, or sexually suggestive material intended for adult audiences is strictly prohibited. Merkosi reserves the right to remove any content that violates this standard.

Enforcement
Merkosi may remove content, disable listings, suspend payouts, or terminate accounts that violate these standards. Repeated or severe violations may result in permanent removal from the platform.

9. Shipping & Fulfillment

Creators are responsible for accurate and timely order fulfillment.

Shipping timelines vary by product and creator. Estimated production and shipping times are provided on individual product pages. Creators must ship within their stated processing time. Failure to ship within stated time may result in order cancellation and creator penalties.

Tracking Requirements:
All physical orders must be shipped with valid, trackable shipping services. Creators must upload accurate tracking information at the time of fulfillment. 

Signature Confirmation:
Orders with a product value of $150 or more must be shipped with signature confirmation. Failure to obtain signature confirmation may result in creator liability in the event of a dispute or chargeback. 

For items valued at $300 or more, creators are strongly encouraged to purchase shipping insurance. Merkosi reserves the right to require insurance for high-risk categories.

Shipping Accuracy:
Creators must provide accurate product weights and shipping information. Failure to provide accurate details that result in underpaid postage, delivery issues, or disputes may result in creator responsibility for associated costs.

Delivery Responsibility:
Creators are responsible for shipping orders on time with valid tracking and signature confirmation where required. If a creator fulfills these obligations and a package is still lost in transit, Merkosi will cover the cost of the refund and file a carrier claim on the creator's behalf where applicable.

If a creator fails to provide valid tracking or signature confirmation when required, the creator may be held responsible for lost-package claims, chargebacks, or dispute fees.

Merkosi is not responsible for delays caused by shipping carriers, customs processing, or events beyond either party's control. Merkosi reserves the right to suspend selling privileges for repeated fulfillment failures.

10. Limitation of Liability

Merkosi is not liable for indirect, incidental, or consequential damages arising from the use of this site or products purchased through it, to the fullest extent permitted by law.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
